Bike accidents have seen an increase in prevalence in the past few years. UDOT stated that in 2024 one-third of the road fatalities were vulnerable road users, like bicyclists.
Have you ever been bicycling on the road, in the bike lane, and you were pushed off the road by a vehicle? This can happen pretty often on the roads, and it can be super dangerous for bicyclists and drivers. Bicyclists in these bike lanes often have to look out for cars that might swerve into the lanes, but they also need to watch for cars that are parked or stopped in their way.
This is no longer the case for bicyclists in Utah, as a new law has now made it illegal for cars to park, stop, or drive in the bike lane. H.B.290 went into effect statewide in May this year, as a way to promote safer roads for bicyclists. The exception to this law is snow plows and emergency vehicles.
According to Rep. Verona Mauga, who advocated for this new law, said, “Bike lanes reduce accidents by up to 49% but only when they are clear and usable.”
Drivers can cross these lanes when they are turning into an intersection, street, or parking lot.
Because cars cause the most obstruction to these bike lanes, it is most important for drivers to know and be aware of the new laws. Law enforcement can only do so much to create awareness, but the courtesy from drivers to keep these lanes clear will do the most help.
There are many more ways drivers can protect the more vulnerable bicyclists. Utah has a law stating that “motorists may not pass within 3-feet of a moving bicycle” as stated by the Utah Department of Public Safety. Drivers and bicyclists should also note that bicycles abide by most traffic laws. This means that when you are merging onto the road, all vehicles AND bicycles traveling in the continuing lane get the right of way. This is the same for yielding to oncoming traffic and bicyclists when turning left. Motorists are able to pass a bicycle through the centerline, but it must be done safely.
These laws keep these vulnerable road users much safer.
Bicyclists also need to remember and follow the rules of the road. They must obey all traffic laws and signs, ride with the flow of traffic, properly signal their intent to turn or signal, and avoid major freeways and highways.
Even though this law has now taken effect, bicyclists should still be vigilant and defensive while driving. Not every driver will follow the law, and it is important to continue to be aware of your surroundings.
If you are on the same roadways, and you notice a continued obstruction, you can call those in. This can help promote awareness of the new law, and keep other vulnerable road users safe.
